During the Revolutionary War neither British nor German prisoners were given access to American Civilian Courts.
In none of the five (5) United States Declared Wars (War of 1812, Mexican-American War, Spanish American War, World War I, World War II) has a single Prisoner of War been granted access to American Civilian Courts.
During WW-II thousands of German prisoners of war were housed in prison camps here in the States. None were given access to Civilian Courts.
When German saboteurs were captured on U.S. soil during WW-II, they were executed without benefit of Civilian Courts.
During the Civil War neither the North nor the South gave prisoners of war access to Civilian Courts.
In fourteen (14) undeclared wars (Quasi-War, First Barbary War, Second Barbary War, Raid ON Slave Trade, Retaliation on Portugal, Korea -1870, Philippine-American War, Intervention in Russian Revolution, Protection of Lebanon, Viet-Nam War, Multinational Forces in Lebanon, Invasion of Panama, Persian Gulf War), not a single Prisoner of War has been granted access to Civilian Courts.
During the Korean Police Action not a single Prisoner of War was granted access to Civilian Courts.
Today, after 232 years as a nation, after 20 conflicts, the Not-So Supreme court has ruled that every Pioneer of War has (and therefore had) a right to access the American Civilian Court System, even when they are Unlawful Enemy Combatants.
One might assume that Franklin Roosevelt would also be guilty of murder for ordering the execution of the German Saboteurs.
Five exceedingly stupid liberal judges have, today, shredded the U.S. Constitution and the Geneva Conventions.
These are the kind of judicial A—Holes that BO promises to appoint if he becomes President.
I fear that we are rapidly approaching the day in which the only way to restore Constructional order in this country will be another Civil War.
If our Congress was not both Mindless and Spineless they would impeach the five judges because they made up law instead of applying the Constitution.
If this does not convince you that Liberalism is the enemy of Democracy, nothing will.
Commanders in the field need to apply so much firepower that no enemy survives to surrender.
Better yet, the President should tell the Court to go to hell! They have exceeded their Constitutional authority!
